The FY 1994 National Defense Authorization Act barred R&D that could lead to production of a nuclear weapon with an explosive yield under 5 kilotons. In 1999, the Department of Energy(DOE), out of concern over violating that ban, could not help the Department of Defense(DOD) study defeating deeply buried or hardened targets. In response, Congress included in the FY 2001 National Defense Authorization Act a provision directing DOE to help DOD with such a study. This report provides technical and legislative background, strategic implications, and pros and cons of this provision. It is written for those interested in nuclear weapons, nuclear testing arms control, nonproliferation, and weapons to attack buried targets.
